  1. General

In these Terms of Service, the words "we", "us", "our" and "Nora Janne" refer to Nora Janne, trading under the trade name Nora Janne.

By visiting our website, creating an account or placing an order, you agree to these Terms of Service, our Privacy Policy and our Returns and Refund Policy.

These terms do not affect your mandatory statutory consumer rights.

  1. Use of our online shop

You may use our online shop for lawful purposes only.

You confirm that the information you provide when placing an order, creating an account or otherwise contacting us is correct, complete and up to date.

You are responsible for keeping your account details confidential and for any activity that takes place through your account.

You may not use our online shop to:

breach any laws or regulations;

commit fraud;

provide false information;

damage or disrupt our systems;

spread viruses or harmful software;

collect other people's personal data without their consent;

copy or commercially exploit our content or website without permission;

use automated systems to scrape, copy or overload our online shop without authorisation;

mislead other people or businesses, or impersonate another person or business.

We reserve the right to restrict, suspend or terminate accounts or access to our online shop where there is a legitimate reason to do so. This may include, among other things, fraud, abuse of return or refund arrangements, repeatedly submitting unjustified return or refund requests, deliberately causing damage to our business, abuse of our goodwill, misleading behaviour, or a serious or repeated breach of these Terms of Service. Repeated return or refund requests that, based on reasonably available information, can be regarded as a pattern of abuse may lead to future orders being refused without further notice, regardless of whether an individual request would be justified on its own.

Where, based on reasonably available information, we suspect that a customer is deliberately or systematically abusing our return, refund or other arrangements, we may restrict or refuse future orders, return requests or other services, to the extent permitted by law.

This provision is not intended to limit or exclude statutory consumer rights.

  1. Our products

Nora Janne mainly sells fashion products, including clothing, accessories, shoes, jewellery, handbags, gloves and headwear.

We make reasonable efforts to show product information, images, colours, dimensions and other product characteristics as accurately as possible.

Product images on our website may have been generated or edited, in whole or in part, using artificial intelligence (AI). As a result, there may be limited and non-material differences between the image on our website and the product actually delivered, for example in colour, lighting, shadows, how the product looks on the model, background, fit or small visual details.

In addition, the actual colour of a product may differ slightly depending on your screen, device or settings.

Small differences in material, finish, colour, size or appearance do not automatically constitute a defect, provided that the product conforms to the contract and the applicable legal requirements.

We reserve the right to change products, product information, images, availability and prices.

  1. Product use and customer responsibility

Our products are designed and sold for their normal and reasonably expected use as fashion products.

For example, a garment is intended to be worn as a garment. A handbag is intended to carry personal belongings. Shoes are intended to be worn normally. Jewellery is intended to be worn as an accessory.

You are responsible for using a product in a way that matches its nature, its function and any safety information provided with it.

We are not responsible for damage caused solely because a product:

is used for a purpose other than the one it was reasonably designed for;

is used in an abnormal or unforeseeable way;

is deliberately misused;

is adapted, altered or repaired without our permission;

is combined with other products or materials in a way the product is not intended for;

is used in conditions for which the product is not suitable;

is exposed to conditions that are not reasonably part of normal use;

is used contrary to any product, care or safety instructions provided with the product.

This applies, for example, to using a garment, accessory or other fashion product for a purpose it was not designed for.

The mere fact that a product is used for an unusual, dangerous or other purpose does not make such use a normal or foreseeable use of the product.

Where damage results solely from incorrect, improper, abnormal or reasonably unforeseeable use of a product by the customer or a third party, Nora Janne cannot be held liable for it, to the extent that such liability can validly be excluded under the applicable law.

  1. Care and handling

Where care, washing or other instructions for use are provided with a product, you must follow those instructions.

Damage caused solely by:

incorrect washing;

incorrect drying;

incorrect ironing;

use of unsuitable cleaning products;

use of bleach;

incorrect care;

storage in unsuitable conditions;

or any other handling that does not follow the instructions provided,

cannot be attributed to a product defect where the damage was actually caused by that handling.

Where no specific care instructions are provided, you must handle the product in a normal and reasonable way that suits the nature of the product.

  1. Product safety

We aim to offer only products that meet the applicable legal requirements.

Where specific safety information, warnings or instructions for use apply to a particular product, you must read and follow them carefully.

If, after a sale, we discover that a product may pose a safety risk, we may take appropriate measures, including temporarily stopping sales, informing customers or organising a recall where required by law.

  1. External suppliers and fulfilment partners

For the production, sourcing, processing, fulfilment and shipping of certain products, we work with external partners, including CJdropshipping.

These external parties may be involved in the production, storage, processing, packaging or shipping of products.

To the extent permitted by law, we are not responsible for damage caused solely by an act or omission of an external party for which we cannot legally be held responsible.

This does not remove our legal obligations towards consumers.

Where a product defect or safety issue demonstrably results from production, materials, design, packaging or any other cause within the responsibility of an external supplier, we reserve the right to exercise our contractual rights against that supplier.

  1. Orders

When you place an order, you will receive an electronic confirmation of your order.

An order confirmation only confirms that we have received your order and does not constitute our acceptance of it. The contract is only formed when we ship your order or expressly accept it. Until then, we may refuse or cancel an order, for example because of an obvious error, a stock issue or suspected abuse, and refund any amount already paid.

Orders are processed subject to availability, correct pricing information and successful payment.

If we are unable to fulfil an order, for example because of an obvious pricing error, a stock issue, a technical error or another legitimate reason, we may cancel the order and refund any amount already paid.

We will let you know as soon as possible.

  1. Prices and payments

The current product price is shown at the time you place your order.

We may change prices, promotions and offers.

A price change does not affect an order that has already been validly placed and confirmed, except in the case of obvious errors or other circumstances permitted by law.

Payments are processed through the available payment providers, including Shopify and Mollie.

We do not store full payment card details where these are processed directly by the relevant payment provider.

  1. Promotions and discounts

Promotions, discount codes and offers may be subject to additional terms.

Where specific promotion terms are stated, they apply together with these Terms of Service.

We may end a promotion when the stated period has expired or when the promotion terms allow it.

A discount or promotion never limits your statutory consumer rights.

  1. Delivery

We currently deliver to Belgium, the Netherlands, France, Spain and Ireland.

If we deliver to other countries in the future, additional delivery terms may apply.

Stated delivery times are indicative, unless a guaranteed delivery period has been expressly agreed.

If a delivery is delayed by circumstances beyond our reasonable control, we will make every effort to have the order delivered as quickly as possible.

  1. Returns and refunds

Returns and refunds are handled in accordance with our separate Returns and Refund Policy.

By placing an order, you agree that returns will be handled according to the procedure described in that policy.

Nothing in these Terms of Service limits your statutory right of withdrawal or any other mandatory consumer rights.

  1. Intellectual property

All content on the Nora Janne online shop, including text, photos, images, logos, designs, videos, graphic elements and brand names, belongs to Nora Janne or the relevant rights holder.

You may not copy, distribute, modify, publish, sell or commercially use this content without prior written permission.

  1. Reviews and other user content

If you voluntarily provide us with a review, photo, feedback or other content, you confirm that you hold the necessary rights to share that content.

You may not submit content that:

is illegal;

is misleading;

infringes the rights of third parties;

is offensive or threatening;

contains spam or malware;

or is otherwise unlawful.

We may remove content where there is a legitimate reason to do so.

  1. External services and links

Our online shop may use external services, apps and links to third-party websites.

We do not have full control over the operation, availability, content or security of external websites.

When you visit an external website, you do so under the terms and privacy policy of that external party.

  1. Liability

We are only liable for damage to the extent that such liability can be attributed to us under mandatory applicable law.

To the extent permitted by law, we are not liable for damage caused solely by:

incorrect, improper or abnormal use of a product;

use for a purpose other than the one for which the product is reasonably intended;

use contrary to the safety, usage or care instructions provided;

changes or adjustments made by you;

incorrect handling or care;

normal wear and tear;

damage caused by the customer or a third party;

use in conditions for which the product was not designed or reasonably intended;

or other causes beyond our reasonable control for which we are not liable under the law.

Nor are we liable for indirect or consequential damage, to the extent that such a limitation is valid under the applicable law.

16bis. Limitation of liability

To the extent permitted by law, our total liability for damage arising from or in connection with an order is in any event limited to the amount you paid for the product concerned. This limitation does not apply to damage resulting from intent or gross negligence on our part, nor to damage due to death or personal injury, nor in any other cases where such a limitation is not permitted by law.

  1. No liability for improper use

Our products are sold as fashion products.

We cannot be held responsible if a customer, knowingly or unknowingly, uses a product for an application that does not match the product's normal function or reasonably expected use.

This applies, for example, where a fashion product is used as a tool, fastening device, construction material, safety device or for any other application for which it was not designed.

To the extent permitted by law, the risk of such use lies entirely with the person who uses the product for that purpose.

This provision applies only to damage that actually results from the improper or abnormal use and does not limit any liability that remains with us under mandatory law.

  1. Indemnity

To the extent permitted by law, you agree to indemnify Nora Janne against third-party claims arising directly from:

your breach of these Terms of Service;

your unlawful use of our online shop;

your deliberate or negligent misuse of a product;

your infringement of third-party rights;

or your use of products for a purpose for which they are not reasonably intended.

This indemnity does not apply to the extent that the damage or claim concerned results from an error, negligence or legal responsibility of Nora Janne that cannot be excluded by contract.

  1. Artificial intelligence

Our product images may have been generated or edited, in whole or in part, using AI. As a result, there may be small visual differences between the image and the product actually delivered.

  1. Force majeure

We are not liable for delay or non-performance where this results from circumstances beyond our reasonable control.

These may include, among other things:

natural disasters;

war;

strikes;

pandemics;

serious disruptions to transport networks;

outages at external service providers;

cyber incidents;

government measures;

import or export restrictions;

serious disruptions in the supply chain.

Where such a situation significantly affects our performance of a contract, we will make reasonable efforts to limit the consequences.

  1. Privacy

Personal data is processed in accordance with our Privacy Policy.

By using our online shop, you acknowledge that you have read the Privacy Policy.

  1. Severability

If any provision of these Terms of Service is declared wholly or partly invalid or unenforceable, the rest of these Terms of Service will remain in full force and effect.

The provision concerned will, to the extent legally possible, be replaced by a valid provision that comes as close as possible to its original purpose.

  1. Changes to these Terms of Service

We may amend these Terms of Service from time to time to reflect changes in our activities, products, services or legal obligations.

The most recent version is published on this page.

Significant changes will be communicated where required by law.

  1. Governing law

These Terms of Service are governed by Belgian law, without prejudice to the mandatory consumer protection rules that apply to you if you live in another EU Member State.

Disputes will be handled by the competent courts in accordance with the applicable Belgian and European rules.
